Time for reflection, withdrawal and return: What are your rights?

Certain contracts benefit from easy and particularly quick modalities of subscription. To allow the consumer to come back on a rapid choice which would prove to be poor, law has determined the so-called time of reflection, of withdrawal or return.

The withdrawal period or reflection allows the purchaser of a contract to waive it for a period defined by the law or the contract itself.

The term “reflection” or “withdrawal” depends on the act in question; it generally varies between 7 and 30 days.

It is only for contracts authentic and provided that the purchaser is not a professional in the industry.

What are your rights?
The reflection periods, withdrawal or return will vary depending on the type of contract signed. Here are your rights for existing main acts:

Consumer credit:

  • withdrawal period: 14 days after acceptance of the offer;
  • Ways: sending withdrawal slip with acknowledgment of receipt.

Mortgage:

  • Reflection period: 10 days after receipt of the supply of credit;
  • Ways: sending letter with acknowledgment of receipt.

Door-to-door sales:

  • Withdrawal period: 7 days after signing the contract;
  • Ways: sending contract and withdrawal form with acknowledgment of receipt.


Distance selling:

  • Withdrawal period: 7 days after receipt of the order;
  • Terms: The return of the product paid by the subscriber.

Life Insurance:

  • Withdrawal period: 30 days after notification of the contract;
  • Ways: sending letter with acknowledgment of receipt.


Distance learning:

  • Reflection period: 7 days after receipt of the project;
  • Ways: sending letter with acknowledgment of receipt.
