In life, zero risk does not exist in virtually none of them, not to say absolutely any activity or action which is carried out. Living in itself carries a risk and this must be taken very present. Just as it should be bear in mind that at all levels should put the necessary measures so that the inherent risk as much as possible and minimize this, of course, also applies to the fields of justice and health.
Sometimes, when occurs a misfortune, an accident or something very serious, it is due to the malpractice, to bad faith or, directly, to fraud of who caused this misfortune, accident or occurrence but on many other occasions, the majority could be said, there is no malpractice, fraud or bad faith or in the decisions or actions that can lead to fatal consequences. That’s something you have to bear in mind, as accusing whenever something happens bad someone is a widespread practice which, in many cases, does not conform to reality, because in most cases you are talking about mere accidents, mere circumstances that could have been avoided or not but that were not sought.
Not all events have a guilty, but if a responsible and although, as it was said, not about blame, it is true that there are responsibilities that must be debugged and on the other hand, should allow recouping the damage that has been caused (even if it was unintentionally) to the injured party.
In all areas of life this can and does happen but, without doubt, two of the areas where errors or accidents have a greater significance because of the impact on the affected person may have are the fields of justice and health.
Both areas are two particularly vulnerable because, on the one hand, the issue of justice is talking about such sensitive issues as the freedom of individuals, among others, and in the field of health is speaking of something as important as the own health, as the own physical integrity of the people and even as life itself.
In the whole population, sometimes it seems to be the belief that when in these areas which are so important and sensitive is committed let the word any injustice or some error or accident is very difficult to prosecute anyone who has committed the injustice or that it is very difficult to be indemnified by the error or the accident which has been suffered, but nothing could be further from the truth.
It is true that when one faces certain estates or organisms, certain professional profiles, may appear not easy to face them, and much less to go out winning but, in reality, does not have to be like that.
Obviously, facing each will meet with powerful segments, but obviously also if they have the right and the tests to prove it can win. Moreover, the concept of unionism, in many sectors, and opacity, it may be true in some cases, that are some loopholes but increasingly are facing an open society in which the abuses of the past are no longer produced.
In the current environment, there are upper echelons, agencies and entities that ensure the proper functioning of the systems and pursuing the recognition of rights, so that it is becoming easier to get the same are we respected and compensated for damages caused. Of course, obviously, this is not a white letter to claim everything and what we please because, in many cases, there are many people who believe and think with every reason in the world and the bad guys are always others and the administration that “pursues” when in fact the opposite is true.
One final note: in most professions we are talking about professionals who carry out them are provided with insurances of legal liability and others that protect them in case of committing errors, of which happen accidents, etc. So, in many cases, it is not even enough to litigate but move the threads to charge which corresponds.
